The decisions
Oakville's Committee of Adjustment had six minor variance applications on its agenda for its electronic hearing on Wednesday, October 28. The signed Notices of Decision attached to the meeting's agenda record decisions on five of them, each dated October 28: four approved with conditions and one denied.
- Approved: all 13 variances for a four-storey residential building in the Central Business District zone, on condition that it is built to the final approved site plan and elevations (SP.1613.106/01). The approval lapses after two years without a building permit.
- Approved: a car wash with its pay stations 3.50 m from the rear lot line, where 7.50 m is required, on condition that it is built to the final approved site plan (SP.1626.021/01). Two-year lapse.
- Approved: a two-storey house with a parapet 0.662 m above the maximum height (0.3 m permitted) and lot coverage of 28.91% (25% permitted). Two-year lapse.
- Approved: a two-storey house with a 7.50 m front yard (9.89 m required) and a height of 9.30 m (9.00 m permitted). Two-year lapse.
- Denied: a two-storey house with a residential floor area ratio of 39.30% (37.0% permitted) and a 1.25 m west side yard (1.80 m required).
- No Notice of Decision posted as of the morning of October 30.
160 Trafalgar Road
The largest file was a four-storey residential building at 160 Trafalgar Road, downtown. The Committee approved all 13 variances requested. Among them: a fourth-level balcony projecting 4.26 metres beyond the main wall where 1.5 metres is permitted; a 3.43-metre access to the parking area, served by a car elevator, where 5.5 metres is required; a front yard of up to 5.27 metres where the maximum is 3.0 metres; building heights of 15.0 metres where 14.2 to 14.6 metres is permitted; a height of 19.9 metres including the rooftop mechanical penthouse where 16.0 metres is permitted; and a rear yard of 0.94 metres where 3.0 metres is required.
The notice records two written submissions from the public opposing the application and one oral submission in support. The Committee found the variances minor, desirable for the use of the land and in keeping with the general intent of the Town's Official Plan and zoning by-law, subject to its conditions.
Venetia Drive variances refused, three other approvals
For 1562 Venetia Drive, an application deferred from April 1, the Committee denied both variances for a new two-storey house. The notice says no written or oral submissions were received from the public, and that the Committee found the variances not minor, not desirable for the use of the land and not in keeping with the general intent of the Official Plan and zoning by-law.
At 1247 Crawford Court, the notice says one written submission in opposition was received and then withdrawn before the hearing. No public submissions are recorded for 177 Woodhaven Park Drive or for the car wash at 624 Third Line.
80 Second Street
The agenda item for 80 Second Street, where the application sought three variances (a reduced side yard and higher floor area ratio and lot coverage) for additions to the house, carries an addendum listing two emails or letters in opposition but, as of the morning of October 30, no Notice of Decision. The file does not appear on the Committee's November 11 agenda. OakvilleIQ will report the outcome once the Town posts it.
Appeals
Each notice says the decision can be appealed to the Ontario Land Tribunal through the Tribunal's e-file service, or through the Town's Committee of Adjustment office for a processing fee, no later than 4:30 p.m. on Tuesday, November 17, 2026. The Town's Committee of Adjustment page says an appeal can be made by the applicant or agent, a specified person or a public body. The hearing notices for these files said there are no third-party appeal rights.
